User agreement

1. Definition of terms
 

In this user agreement, the terms used have the following meanings:
 

1.1. Concept Stay – LIMITED LIABILITY COMPANY "CONCEPT STAY", registered and operating in accordance with the legislation of Ukraine.

1.2. A guest is any legally competent natural person who has reached 18 (eighteen) years of age at the time of concluding the Agreement.

1.3. Services – temporary accommodation (accommodation) services provided by hotels and similar means of temporary accommodation.

1.4. Agreement means this User Agreement.

1.5. Means of accommodation - means of accommodation provided to the Guest.

1.6. Booking – reservation of the Accommodation Facility by the Guest for a specified period of time.

1.7. Website – web page on the Internet at the link: https://www.concept-stay.com/

1.8. A payment system is a legal entity that processes and executes payments using bank cards and has the appropriate license of the National Bank of Ukraine to perform such actions.

1.9. Promo code – a unique code generated by Concept Stay or ordered by Concept Stay, which gives the Guest a discount in the amount determined by Concept Stay on the Services.

 

2. Subject of the Agreement and its general provisions
 

2.1. Concept Stay provides, and the Guest accepts and pays for, the Services provided by Concept Stay to the Guest.

2.2. This Agreement is a public contract concluded between Concept Stay and the Guest and regulates the relationship between Concept Stay and the Guest regarding the provision of Services.

2.3. This Agreement, as amended, is posted on the Website.

2.4. This Agreement is concluded between Concept Stay and the Guest at the same time as the Guest makes a Reservation.

2.5. By making a Reservation, the Guest confirms that he is familiar with and fully agrees with the terms of this Agreement and the Privacy Policy, accepts the offer to conclude the Agreement and consents to the processing of his personal data.

2.6. When concluding the Agreement, the Guest confirms that he has the appropriate amount of rights to conclude it, is not limited by law or other regulatory act, court decision, or in any other way in the right to conclude and perform the Agreement.

 

3. Booking
 

3.1. To conclude the Agreement and receive the Services, the Guest must make a Reservation using the Website. The Guest cannot make a Reservation without agreeing to the Agreement and the Privacy Policy.

3.2. During the Booking, the Guest indicates his/her:

  • name and surname;

  • e-mail address;

  • phone number.

3.3. Concept Stay guarantees the Guest that Concept Stay will not use the information provided by the Guest during the Booking for any other purposes, except for the provision of Services and the purposes stipulated in this Agreement.

3.4. The result of the Guest Reservation is the reservation of the Accommodation Facility for the Guest for a specified period of time.

3.5. The guest independently ensures the preservation of the information necessary to access his own Booking and all, without exception, the information contained in it.

3.6. Concept Stay guarantees the Guest that Concept Stay will not take any actions regarding the transfer of information about the Guest's Reservation and the information contained in it, except in the cases and to the extent necessary to provide such information:

  • to third parties to ensure that Guests receive Services;

  • at the request of law enforcement agencies;

  • at the request of judicial authorities;

  • in other cases determined by the legislation of Ukraine.

3.7. Concept Stay is not responsible for the consequences of the Guest's loss of information or access to information about his Reservation.

 

4. Cost of services and payment procedure
 

4.1. Concept Stay provides Services to the Guest on a paid basis.

4.2. Concept Stay independently determines the cost of its own Services.

4.3. The cost of Concept Stay Services is indicated on the Website.

4.4. The cost of the Services may vary depending on the Accommodation Means chosen by the Guest.

4.5. The cost of the Services is set in the national currency of Ukraine - the hryvnia.

4.6. The cost of Services can be changed unilaterally by Concept Stay until the moment of payment by the Guest.

4.7. Payment for Services can be made by the Guest exclusively in non-cash form.

4.8. When paying for the Services in non-cash form, the Guest will be redirected to the website of the Payment System, which will be used to receive and transfer the Guest's funds.

4.9. Concept Stay does not have access to and does not collect, record, use and process information that is or may be directly or indirectly related to the Guest's bank cards or other payment information.

4.10. In the event of any questions or problems related to the payment of the Services, the Guest must address such questions or solve such problems directly with the Payment System.

4.11. Concept Stay has the right not to provide Services to a Guest who has not paid for Services.

 

Payment methods

 

 

 

5. Promo codes
 

5.1. Concept Stay can provide the Guest with Promo Codes.

5.2. In order to use the Promo Code, the Guest must enter it in the "Add Promo Code" field on the Website before making the payment.

5.3. Terms of use of Promo codes:

  • Promo codes may not be copied, sold, transferred or disclosed;

  • Promo codes may be invalidated or canceled by Concept Stay at any time and for any reason, or without such reason;

  • Promo codes are not exchangeable or refundable;

  • Promo codes are not restored if they are lost;

  • The promo code cannot be exchanged for cash or any other good.

 

6. Refusal to provide Services
 

6.1. Concept Stay has the right to refuse the provision of Services to the Guest (including canceling the Guest's reservation) in the following cases:

  • Violation by the Guest of the terms of this Agreement;

  • Provision of inaccurate information by Guests during Booking;

  • If the Guest's actions lead or may lead to a violation of the rights of Concept Stay or the rights of third parties;

  • If the Guest's actions lead or may lead to a violation of the current legislation of Ukraine;

  • If the Guest's actions lead or may lead to third-party claims against Concept Stay.

 

7. Refunds
 

7.1. The Guest has the right to refuse to receive the Services and request a return in the cases specified in the Agreement.

7.2. To process a refund request, the Guest must provide Concept Stay with the following information and documents:

  • Surname, first name and patronymic;

  • Registration number of the taxpayer's account card;

  • Registration address;

  • Bank account number in IBAN format and bank card number from which the payment was made;

  • A scanned copy of the Payment System receipt confirming payment for the Services.

7.3. In the case of receiving a request for a refund within the period specified by this Agreement, providing the information and documents specified by this Agreement, Concept Stay will refund the money to the Guest within 30 (thirty) calendar days from the date of receipt of such a request.

7.4. The Guest's non-compliance with the term specified in this Agreement and/or the Guest's failure to fulfill any of the conditions specified in this Agreement is grounds for refusing to return the funds to him.

 

8. Booking rules
 

8.1. Concept Stay establishes the following rules for the Guest's check-in and check-out:

  • Check-in: from 14:00;

  • Departure: before 10:00;

8.2. The guest has the right to cancel the reservation 7 (seven) calendar days before the date of arrival without charging any fee;

8.3. In case of cancellation of the Reservation by the Guest less than 7 (seven) calendar days before the date of arrival or in case of non-arrival of the Guest on the specified date, the Guest is obliged to pay the full cost of the Services.

 

9. AS IS
 

9.1. Services are provided by Concept Stay on an "as is" basis. This means that Concept Stay provides the Services and the Guest receives the Services in the form in which they can be provided at the present time, in accordance with the technical, operational and other capabilities of the Concept Stay and that the Guest accepts the Services in advance with all the shortcomings that appeared immediately or may appear later.

9.2. The Guest does not have the right to make any claims or demands against Concept Stay in connection with the fact that the Services do not meet any expectations or provisions not specified in this Agreement, or that the Website, the Payment System or any -what other third-party and/or related services and services may operate intermittently, unreliably or with certain errors.


10. Liability
 

10.1. Concept Stay is not responsible for:

  • Impossibility of providing Services, for reasons beyond Concept Stay's control;

  • Actions of any third parties;

  • Any damage or loss caused through no fault of Concept Stay.

10.2. Concept Stay is responsible for violation of the terms of service provision.

10.3. The guest is responsible for:

  • Destruction or damage to Concept Stay property;

  • Use of the Placement Tool in violation of the terms of this Agreement;

10.4. Concept Stay does not guarantee and is not responsible for the possibility or impossibility of making a payment by bank card using the Payment System, for the correct operation of the Payment System, for ensuring the preservation and security of information provided to the Payment System by Guests to make a payment using a bank card.

10.5. Concept Stay is not responsible for any material or moral damage, any direct or indirect damage that was or could be caused to the Guest as a result of force majeure.

10.6. The Guest is responsible for the risk of accidental destruction and/or accidental damage to Concept Stay property to the extent of the value of such property, or to the extent of the cost of restorative repair of such property. Payment of the cost of restorative repairs or property destroyed due to the Guest's fault must be made by the Guest before the Guest's departure or within 1 (one) banking day from the day the Guest receives the corresponding request from Concept Stay. In the event that the Guest fails to pay the cost of restorative repairs or property destroyed due to the Guest's fault within the period stipulated in this clause, the Guest is additionally obliged to pay Concept Stay a fine of 10% of the cost of restorative repairs or property destroyed due to the Guest's fault for every 10 calendar days of delay.

10.7. Notwithstanding any provisions set forth in this Agreement, Concept Stay declares, and the Guest accepts and agrees, that any material liability of Concept Stay will be limited to the value of the Services paid by the Guest.

 

11. Collection and accounting of personal data
 

11.1. All features directly or indirectly related to the processing and protection of the Guest's personal data are determined by the Privacy Policy posted on the Website.

11.2. By making a reservation, the Guest confirms that he has read and fully agrees with the Privacy Policy.

 

12. Application of legislation
 

12.1. This Agreement and the relations of the Parties not regulated by this Agreement shall be governed by the legislation of Ukraine and the international legislation recognized by the State of Ukraine in accordance with the established procedure.

 

13. Amendments to this Agreement
 

13.1. Concept Stay has the right to unilaterally make changes or additions to this Agreement, with or without notice to the Guest, and the Guest accepts such right of Concept Stay and gives its irrevocable consent to Concept Stay making such changes and additions.

13.2. If the Guest continues to use the Concept Stay Services, it means that he unquestionably accepts the changes or additions made by Concept Stay.

13.3. If the Guest does not accept the changes or additions made by Concept Stay, he is obliged to notify Concept Stay about this by sending a written message to the address of Concept Stay. In this case, the Guest does not receive the Service and has the right to a refund under the conditions and in the manner set forth in this Agreement.

 

14. Validity of provisions
 

14.1. In the event that the provisions of this Agreement differ from the provisions set forth on the Website (including, but not limited to) and/or additional terms of Services not specified in this Agreement, but specified on the Website, the provisions set forth in Website.

14.2. If one or more provisions of this Agreement are found by a court to be invalid or void, all other provisions shall remain in full force and effect.
